TERMS AND CONDITIONS OF USE AND PRIVACY POLICY ACCEPTED IN RELATION TO SKI PASSES, RENTAL OF SKI EQUIPMENT AND SERVICES AT THE STATION

The following document contains the general terms and conditions of use of the services and the privacy policy of Puerto de Navacerrada Estación de Esquí, S.A.

 

Applicable legislation

Law 7/1998 of April 13, on General Contracting Conditions (14-4-1998) and Law 26/1984 of July 19, General for the Defense of Consumers and Users (BOE 24-7-1984) and other current provisions. The fact of acquiring any of the services published in this online Commerce Center, originates the acceptance by the consumer of each and every one of the General Conditions, which are considered automatically incorporated into the contract without the need for a written transcription in it.

 

Ski pass

The Ski Pass is a Transport Pass that entitles the holder to use the facilities open to the public at the time, calendar and conditions established for the practice of defined activities.

To access any ski lift on any date, it is essential to be the owner and bearer of a valid ski pass or ticket for that lift and on that date.

The acquisition of a Ski Pass or a service, the use of the facilities, imply the knowledge and acceptance of these Conditions of Use of the Ski Pass, the Specific Conditions of application, the ATUDEM Regulations and the Rules of the International Ski Federation, without any reservation.

The price of the Ski Pass and the Ticket includes Mandatory Travel Insurance (S.O.V.) and V.A.T., and is detailed in the Official Rates and in the Particular Conditions when applicable.

Minors must be supervised at all times by a responsible adult designated by their legal guardian.

The opening and closing dates of the Season, as well as the opening and closing times of the ski lifts, will be established according to the meteorological, operational and commercial conditions of the Station, the rate ranges and date ranges being reflected in the published calendars, provided and of conditional application.

Interruptions, early closure or limited use of slopes or lifts, due to technical, meteorological or any other causes do not give the right to compensation or restitution of any kind. The validity of the Ski Pass will be determined according to the Calendar in the Official Rates for the current Season and in the Particular Conditions when applicable.

The Ski Pass can be purchased through different channels:

– In person at the Official Ticket Office of Puerto de Navacerrada Estación de Esquí, S.A.

– Remotely at the online Trade Center at www.puertonavacerrada.com

To access any rate or offer based on age, family unit or personal condition, it will be mandatory to present, upon request, the documentation that validates the right to the aforementioned rate

or offer or to the Holder of the ski pass, such as a National Identity Card (D.N.I.), family book, youth card or any other defined in the Particular Conditions of each product registered on our website.

The Ski Pass purchased is personal and non-transferable and enables the use of the ski lift facilities only and exclusively to a single holder and carrier throughout the validity period. The use of the ski pass by another person other than the holder will entail the withdrawal of the pass and cancellation of the rights and services acquired, not proceeding to the right to any refund or compensation.

Puerto de Navacerrada Estación de Esquí, SA, reserves the right to expulsion from the facilities and Mechanical Lifts, to withdraw the Ski Pass, to cancel all rights of the products or services acquired, without prejudice to civil or penalties that could be incurred additionally, in case of inappropriate or dangerous behavior, non-compliance with the instructions given by its staff, insult or aggression of any kind to other users or workers and in general, due to non-compliance with the Rules of Use of the Facilities or Use of the Ski Pass, for which it empowers its staff.

The practice of skiing or snowboarding implies knowledge of the activity and assumption of the risks inherent to the activity practiced, this explicitly exempts Puerto de Navacerrada Estación de Esquí, S.A. of any direct or indirect responsibility, assuming the user the personal, material or medical risks, as well as the Civil Liability and Health Expenses derived from the exercise.

Adult pass TA: Valid for an adult fare on Saturdays, Sundays and holidays; the dates are from December 5th to 8th (both inclusive), from December 23rd to January 10th (both inclusive), Easter from March 27th to April 4th.

Adult Ski Pass TB: Valid for an adult fare on working days from Tuesday to Friday. This voucher cannot be redeemed on Mondays.

Children’s Pass TA: Valid up to 13 years of age on Saturdays, Sundays and Bank Holidays; the dates are from December 5th to 8th (both inclusive), from December 23rd to January 10th (both inclusive), Easter from March 27th to April 4th.

Children’s Pass TB: Valid up to 13 years of age, workdays from Tuesday to Friday. This voucher cannot be redeemed on Mondays.

Adult Pass for Large Families TA: Valid for an adult fare on Saturdays, Sundays and Bank Holidays; dates from December 5th to 8th (both inclusive), from December 23rd to January 10th (both inclusive), Easter from March 27th to April 4th.

Presentation at the ticket office of the documentation accrediting member of a large family (family book, or large family card) together with a National Identity Card (D.N.I.).

Adult Pass for Large Families TB: Valid for an adult fare on weekdays from Tuesday to Friday. This coupon cannot be redeemed on Mondays.

Presentation at the ticket office of a valid youth card in conjunction with a National Identity Card (D.N.I.).

Youth Card Pass TB: Valid for adult rates on workdays from Tuesday to Friday. This coupon cannot be redeemed on Mondays.

Ski Equipment Rental

The rental of ski equipment entitles the owner to receive on loan equipment consisting of skis, boots, helmet and poles and to make use of it within our facilities open to the public at the time, calendar and conditions established for the practice of the defined activities.

Complete ski pack TA: It consists of Ski Boots, Skis, a Helmet and Poles. Valid for adult and children’s rates on Saturdays, Sundays and Bank Holidays; dates from December 5th to 8th (both inclusive), from December 23rd to January 10th (both inclusive), Easter from March 27th to April 4th.

Complete ski pack TB: It consists of Ski Boots, Skis, a Helmet and Poles. Valid for adult and children’s rates on weekdays from Monday to Friday.

 

Payment method

The payment method to make a purchase in our Commerce Center is a Virtual POS, accepting EXCLUSIVELY payment by credit or debit card. Puerto de Navacerrada Estación de Esquí, S.A., does not keep the numbers of its customers’ Credit Cards at any time for security measures, but rather serves exclusively as a payment gateway to the aforementioned POS.

The NO acceptance of a customer’s Credit or Debit Card by the Virtual POS is not the responsibility of Puerto de Navacerrada Estación de Esquí, S.A., as it may be due to various

causes, totally unrelated to Puerto de Navacerrada Estación de Esquí, S.A. (expiration of the card, balance restriction, saturation of the network, activation of the card for purchases in online stores, etc.) being the duty of the customer to verify and communicate the problem to their bank to resolve the incident and thus be able to carry out carry out the transaction.

The purchase of the services will not be effective until the order is paid for the full amount of said reservation and the POS returns the customer a paid transaction locator (Paid Order), together with a transaction code.

 

Product redemption and delivery

The client will receive the purchase voucher by means of a confirmation of the purchased product to the email provided. You can collect both the ski pass (in the acquired modality) and the documentation of the ski equipment rental, at the ticket office of the Ski Resort.

 

Cancellation or withdrawal

In case of withdrawal of the products purchased contracted through Puerto de Navacerrada Estación de Esquí, S.A., the client has the right to a refund of the amounts that they have paid, with a deduction of those amounts that are accrued in terms of cancellation fees (if any). The client has the right to withdraw from the purchase made within 15 calendar days, counting from the day the client received the purchase confirmation email, unless said right is not applicable in accordance with the Law and thus the special conditions of the offer are specified. In the case of exchange of the purchased product, all rights to withdraw from the purchase will be lost.

 

Modifications

Unless expressly authorized by Puerto de Navacerrada Estación de Esquí, S.A., the Client is not allowed to change the owner of a purchase already made. Any of these changes without the authorization required by Puerto de Navacerrada Estación de Esquí, S.A., will be treated as a cancellation of the product. Any modification, requested by the user, of the agreed conditions, will originate from the management costs that this entails.

 

Responsibilities

The Organizer (Puerto de Navacerrada Estación de Esquí, S.A.) and supplier will respond to the consumer, for the correct fulfillment of the obligations derived from the contract. There will be joint responsibility when different organizers or retailers concur in the contract, regardless of their class and the relationships that exist between them.

However, the intervening agents will be exempted from said responsibility when:

– The defects are attributable to the consumer.

– When the defects are attributable to a third party outside the provision of the planned services and are unpredictable and insurmountable.

– That the defects are due to reasons of force majeure or sufficient cause, and are unforeseeable and unavoidable.

– That the defects are due to an event that the retailer, or where appropriate the organizer, despite having put all the necessary diligence, could not foresee or overcome.

Information

Station hours, Monday to Sunday from 9:00 a.m. to 5:00 p.m., with the last climb of the ski lifts at 4:45 p.m.
